Avenatti’s Legal Troubles Resemble Trump More Than Either Would Like to Admit

For a brief time, lawyer Michael Avenatti seemed to constitute a perfectly-matched Trump nemesis. As Avenatti emerged as ringleader of the #Basta Circus, Americans and media alike were captivated by his irresistible brand of brash arrogance. Much like Trump himself, Avenatti was undeterred by fierce critique or realistic consequence–always ready to strike first and punch back, and never particularly concerned about the wisdom of surrounding himself with porn stars.

It sure was fun while it lasted. Avenatti will almost certainly lose his law license. Much of his alleged wrongdoing is directly connected to his work with clients. To underscore the point, he was arrested for an alleged violation of his bail conditions during his disciplinary hearing. But now that Avenatti is facing multiple federal criminal charges coast to coast, likely disbarment, and general disgrace, we’re left with the truth we knew all along: Avenatti and Trump are two sides of the same coin. We’ll leave the psychoanalysis to the experts, but we’re here to do a little legal side-by-side. The similarities are pretty staggering.

It should be noted: Avenatti has denied all allegations of wrongdoing and recently told Law&Crime that he expects to be fully exonerated.

1. Extortion: Under federal law, this is the offense of exchanging threats for value.

Avenatti allegedly threatened Nike: either the company agreed to pay Avenatti $25 million, or Avenatti would hold a press conference at a critical time for Nike’s financial health, and reveal all sorts of dirt on the company.

Trump too, has been accused of extortion. Of course, as a sitting president, Trump cannot be indicted, but the accusation and the impeachment is there just the same. The reality of extortion is that it sometimes looks like a threat, while other times, it looks like a promise. President Trump withholding and conditioning the release of nearly $400 million in military aid to Ukraine on an announcement of investigation into Joe Biden and family is precisely the kind of promise that could amount to extortion.

2. Wire Fraud: A person is guilty of wire fraud when they communicate their schemes to defraud.

According to one pending criminal complaint, Avenatti got over $4 million in loans from a Mississippi bank by submitting false tax returns.

Democrats, in their official report recommending that Trump be removed from office, alleged that in the infamously “perfect” phone call, Trump “willfully set out to defraud the American people” by advancing the scheme over the phone and failing to provide “honest services” as president.

3. Tax Crimes.

Avenatti has been charged with violation of several criminal tax laws. Among them are Attempts to interfere with administration of internal revenue laws, and Willful Failure to file returns, supply information. and pay tax. Prosecutors allege that Avenatti never filed returns for the three years prior to 2014, and owed the IRS $850,000 in back taxes.

Donald Trump has also been widely accused of pervasive tax-related wrongdoing, both before and after he was elected president. The accusations against Trump range from the general (that he has shirked an obligation to turn over his tax returns) to the specific (that he profited from the sale of real estate and failed to declare the income). Litigation seeking to mandate a release of Trump’s tax records is proceeding in parallel with the Trump impeachment.

The Supreme Court is expected to rule on the matter in the coming months.

4. Bank Fraud: These are crimes connected with obtaining money or credit from financial institutions by means of false pretenses or promises.

In addition to tax crimes connected to fraudulently obtaining loans, Avenatti also faces prosecution for bank fraud in California. Prosecutors say Avenatti was in financial ruin following a former law partner’s $4.85-million personal judgment against him after Avenatti’s firm failed to pay a debt, and received over $4 million in loans based on false documentation.

President Trump has been accused of similarly misrepresenting his personal assets in dealings with Deutsche Bank. Various reporters have produced detailed articles about Trump’s relationship with Deutsche Bank in which Trump exaggerated his wealth when attempting to get approved for loans.

Though not bank fraud, President Trump recently admitted to (and paid up for) misusing charitable funds for political gain. And then there’s Trump University.

5. False Testimony Under Oath: This offense makes it a crime to knowingly and fraudulently make a false oath or account in relation to any case under title 11 (bankruptcy proceedings).

Avenatti faces four counts of bankruptcy fraud for allegedly failing to report all of his firm’s accounts receivable, and falsely testifying under oath during a bankruptcy hearing by denying the firm had received more than $1.3 million in fees that it actually had received.

Certainly, there is no shortage of examples of demonstrably false statements put forth by Trump in a variety of contexts. Moreover, he has declared bankruptcy more than six times.

Some have suggested that Trump’s restructuring under bankruptcy laws, followed by continued operation of his casinos, could only be the result of his having provided false information during the bankruptcy process. Others have been even more specific, suggesting that Trump committed perjury during a deposition.

Trump’s former lawyer Michael Cohen testified before Congress that Trump knew Felix Sater, a convicted felon once connected to the Russian mafia. That testimony directly contradicted Trump’s testimony from a civil deposition, when he denied knowing or even being able to recognize Sater. We’ve seen similar denials of late from the president, claiming he does not know Lev Parnas. That has backfired.

There is also some speculation that the written answers submitted by Trump to former special counsel Robert Mueller may not have been truthful. Trump denied having ever discussed WikiLeaks with his since-convicted pal Roger Stone, but Mueller witness Rick Gates said he had first-hand knowledge of a Trump-Stone conversation about impending WikiLeaks disclosures.

6. Aggravated Identity Theft: This felony makes it an offense to knowingly transfer, possess, or use the identification of another person.

Although court documents refer to an unnamed “Victim-1,” that person is Stormy Daniels, the porn star who famously alleged an affair with Trump. Through his representation of Daniels, Avenatti became somewhat of a household name. Avenatti allegedly forged Daniels’ signature and had $300,000 of an $800,000 book advance sent directly to him. The funds were allegedly used to cover payroll at Avenatti’s law firm, as well as the coffee chain he owned, dry cleaning bills, and payments on Avenatti’s Ferrari.

On this count, there’s no direct parallel to Donald Trump, but there are some honorable mentions.

Special counsel Robert Mueller relied on the same statute to bring charges of aggravated identity theft against five Russian nationals indicted for conspiracy to interfere in the 2016 U.S. election.

And, as we well know, Donald Trump appears to have regularly used pseudonyms throughout his life and career, some instances of which are detailed in a Fortune piece headlined, “Donald Trump’s Long, Strange History of Using Fake Names.” Who could forget that weird “John Barron” interview and “David Dennison“?

Rudy Giuliani spins wild Ukraine conspiracies as Fox & Friends hosts desperately try to cut him off

Rudy Giuliani breathlessly uncorked new conspiracy theories about Joe Biden’s activity in Ukraine, as nervous “Fox & Friends” hosts tried to cut him off.

President Donald Trump’s personal attorney appeared Friday morning on Fox News, where he expanded on the conspiracies that form the heart of the impeachment case against the president.

“All of a sudden Biden has announced the most important guy in Ukraine, he is going to give out the money, then he hires Biden’s son,” Giuliani said. “Do you know what happened in between? He made a deal with Biden, you be on board against (former president Petro) Poroshenko taking my company, when they move to take the company. That’s when Biden came in and had the prosecutor fired, and within four months the crooked oligarch sitting with $5 billion comes back to the Ukraine, he is not prosecuted. He is sitting there fat and happy with his company.”

Co-host Steve Doocy persistently tried to cut Giuliani off to ask a question, but the president’s lawyer continued ranting anti-Biden conspiracies.

“Then we have got another bribe,” he said. “You don’t think the president of the Ukraine shared in that $5 billion that the crook kept?”

“The bribe to the president of the Ukraine, the amount of money I can’t be absolutely sure of,” Giuliani said, stumbling enough to allow Doocy to finally cut in. “Let’s say well in excess of $10 million.”

Doocy tried to redirect Giuliani, who regained his footing.

“That shouldn’t be revealed?” Giuliani said. “From a lawyer who finds out about this? Am I going to cover it up the way the Democrats and media cover it up? Absolutely not. I prosecuted too many corruption cases to sit by and watch my country sold out by a vice president who did it two other times, at least, in China.”

Co-host Ainsley Earhardt asked how the saga would end, and Guiliani said he hoped Biden would land under investigation.

“You don’t think if these things were said about Donald Trump and Donald Trump Jr. they wouldn’t be under investigation immediately?” Giuliani said. “Instead of putting them under investigation, they are coming after me. They want to kill me.”

Doocy nervously interrupted, and asked when Guiliani would provide proof of his claims.

“Today at noon I will give an introduction,” he said. “Starting next week I will present witnesses, I have them all on tape. We will reveal one at a time, we will show there were two bribes. Not one, actually three.”

Ohio vice police officers fired for wrongfully arresting Stormy Daniels

Two US vice squad police officers were fired for wrongfully arresting porn star Stormy Daniels, who has claimed an affair with President Donald Trump, city officials in Columbus, Ohio confirmed on Friday.

Officers Whitney Lancaster and Steven Rosser were ordered dismissed by Columbus Director of Public Safety Ned Pettus on Thursday, according to documents provided by Pettus’ office.

Two other officers were suspended for the 2018 strip club arrest of Daniels, whose real name is Stephanie Clifford, at the Sirens Gentlemen’s Club on sexual misdemeanor charges.

Daniels had charged in a lawsuit that she was arrested for political reasons related to her claim before the 2016 election that Trump had sought to buy her silence over an affair a decade earlier, to avoid it affecting his prospects in the presidential contest.

The charges said that, while topless at the club, she pushed the faces of customers into her breasts.

The charges against her were quickly dropped following her detention. But she sued the city for false arrest and false imprisonment and the case was settled in September 2019 for $450,000.

Pettus said in the dismissal orders that the two officers took actions against Daniels that “deviated significantly from actions taken at every other strip club investigated by you.”

He pointed out that normally they would file charges against an offender after a club visit and issue a summons for the person’s appearance in court, rather than arresting them on the spot and taking them in to custody as they did with Daniels.

“Not a single other suspect was deprived of their rights by being arrested ‘On View’… except Ms Clifford, demonstrating gross neglect of duty and incompetence,” Pettus wrote.

Prosecutors in New York are investigating payments made to Daniels by Michael Cohen, Trump’s former personal attorney who is in prison for violating campaign finance laws.

Rudy Giuliani Tells Fox Viewers to Watch OAN in Trainwreck Interview With Pirro: My Evidence ‘Gets Censored!’

Rudy Giuliani had another zany TV interview where he called Marie Yovanovitch a “crook,” demonized George Soros again and directed Fox News’ audience to go watch One America News Network (OAN).

Speaking to Fox News’ Jeanine Pirro on Saturday night, Giuliani argued that former Vice President Joe Biden’s a “crook” and called House Judiciary Committee chairman Jerry Nadler a “jackass” helping Biden cover up a “massive scandal.” When Pirro repeatedly asked him for the evidence of his claims, Giuliani claimed that “I got the evidence, I’ve been showing them the evidence for months.”

“I put out the evidence in April, I put it out in March, it was ignored! You saw it on television, on Fox. You saw [Viktor] Shokin testify. It was just on OANN! *It gets censored! You don’t want to look at the evidence! It’s out there.”

Giuliani added, “Go look at the OAN (sic), and then watch my podcast.”

Pirro seemed in a haste to move on as Giuliani claimed “they attempted to murder [Shokin].”

Giuliani was speaking about the fact that, for weeks, he’s been partnering with the OAN’s far-right network to produce a bonkers docu-series in order to advance President Donald Trump’s preferred narratives on Ukraine, the Biden family, and corruption. Part of the series includes Giuliani interviewing Shokin and other controversial Ukrainian officials who have lost their jobs amid their own allegations of corruption.

As the president’s personal lawyer pursued that endeavor, Giuliani, in the meantime, has come under scrutiny for admitting to his role in the Yovanovitch smear campaign. While Giuliani has accused his indicted affiliate, Lev Parnas of spreading “stupid lies” about him, Parnas has released an audio recording of Trump asking him to “get rid of” Yovanovitch by removing her from her job as ambassador to Ukraine.

When Pirro asked Giuliani about this, the former New York mayor claimed he didn’t know Parnas at the time and said he “may not be the most memorable person” there. This shortly led to Giuliani calling Yovanovitch “crooked” and accused her of “trying to help George Soros’ company.”

Giuliani, of course, has repeatedly demonized Soros throughout the Ukraine scandal.

CNN panel cracks up laughing at Trump lawyers trying to make Rudy Giuliani into ‘the coffee boy’

President Donald Trump’s legal team fought Monday to try and claim that Rudy Giuliani had nothing to do with the president’s efforts in Ukraine.

It’s a claim that flies in the face of the documents, testimony, text messages and more that have been revealed throughout the course of the investigation that hangs the albatross around Giuliani’s neck.

In fact, Giuliani crafted his own letter to Ukrainian President Volodymyr Zelensky saying that he was authorized to speak on behalf of President Donald Trump as a “private attorney.” If the president cared so much about corruption in Ukraine, why would he be doing a shadow foreign policy using Giuliani instead of through Congress, Secretary of State Mike Pompeo, the United Nations, the European Union, the International Monetary Fund or a slew of other international groups interested in the issue.

The excuse from the Trump team was that Giuliani was a nobody.

“Rudy Giuliani is a minor player,” Trump lawyer Jane Raskin said. “That shiny object designed to distract you. Senators, I urge you most respectfully: Do not be distracted.”

CNN host Chris Cuomo questioned the attempt, before playing a clip of Giuliani, who admitted to the crime on his show.

“So you did ask Ukraine to look into Joe Biden?” Cuomo asked.

“Of course I did!” Giuliani exclaimed.

The panel of experts cracked up laughing.

“Let me pick up on where Paul left off and it goes right to Giuliani and what this is about in realtime: extortion,” said Watergate reporter Carl Bernstein. “That behavior and a kind of bribe. Exactly what Alan Dershowitz was saying today, he kept saying, ‘Well, if the crime is akin to.’ Well, that’s what we’re looking at — something that is akin to. And I think Dershowitz has opened up a door particularly for Democrats to walk right through and exploit and say, ‘This is exactly what Dershowitz was talking about, extortion, bribery.’ That’s what the president did. that’s what Giuliani participated in.”
